Welcome to the Aquila website. By using our site or purchasing our products, you agree to the terms below.

1. About These Terms

These Terms and Conditions of Sale ("Consumer Terms") apply to purchases made by consumers from Aquila. Aquila is a trading name of KD Spades Limited ("Aquila", "we", "us" or "our").

2. Age Restriction and Alcohol

You must be at least 18 years old to purchase alcohol from us. By placing an order, you confirm that you are aged 18 or over and that any person accepting delivery where age verification is required will also be aged 18 or over.

We and our delivery partners may use age-verification procedures and may require acceptable identification. Delivery may be refused where satisfactory proof of age cannot be provided.

3. Products

We take reasonable care to describe and display our products accurately. Packaging, colour and presentation may vary slightly from images shown online where this does not materially affect the product. Alcohol by volume and other legally required product information will be stated on the product or its packaging as applicable.

4. Prices and Payment

Consumer prices are shown in pounds sterling and include VAT where VAT is applicable, unless clearly stated otherwise. Delivery charges are shown separately before you place your order.

You must provide valid payment details and authorise us to take payment. We may use third-party payment providers to process payments securely.

5. Orders and Contract Formation

Placing an order is an offer to buy the products in your basket. An automated acknowledgement does not necessarily mean that we have accepted your order.

A contract is formed when we send you an order confirmation accepting your order, unless we clearly state a different point of acceptance during checkout.

We may refuse or cancel an order before acceptance where, for example, a product is unavailable, payment cannot be authorised, there is a pricing or description error, we reasonably suspect fraud or misuse, or we cannot lawfully fulfil the order. If we cancel after taking payment, we will refund the relevant amount.

6. Delivery

Available delivery areas, charges and estimated delivery times are shown on our website or at checkout. Unless a different period is agreed with you, we will deliver without undue delay and no later than 30 days after the contract is made.

We are not responsible for delay caused by events outside our reasonable control, but we will contact you where appropriate and take reasonable steps to minimise the effect of the delay.

Risk in the goods passes to you when the goods come into your physical possession, or the possession of a person identified by you to take delivery on your behalf, subject to applicable consumer law.

7. Your Right to Cancel an Online Order

For most goods bought online, you have a legal right to change your mind. You may tell us that you wish to cancel at any time from formation of the contract until 14 days after the day on which you (or a person nominated by you, other than the carrier) receive the goods. If an order is delivered in separate instalments, the period generally runs from receipt of the last item.

To cancel, contact us at hello@aquilagin.com with a clear statement that you wish to cancel. You may use the model cancellation form at the end of these Consumer Terms, but you do not have to.

After notifying us, you must normally return the goods within 14 days. Unless the goods are faulty, not as described, or we agree otherwise, you are responsible for the direct cost of returning them.

You must take reasonable care of goods while they are in your possession. We may make a deduction from the refund for loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Your statutory cancellation right may not apply where a legal exception applies. Nothing in this section limits your separate rights in relation to faulty, damaged or misdescribed goods.

8. Refunds Following Cancellation

Where you validly cancel an order, we will refund payments due under applicable law, including the cost of our least expensive standard delivery option where required. If you chose a more expensive delivery method, we do not have to refund the additional delivery cost.

We may withhold the refund until we receive the goods back or you provide evidence that you have sent them back, whichever occurs first. Refunds will normally be made using the original payment method and within the time required by law.

9. Faulty, Damaged, or Incorrect Goods

We are under a legal duty to supply goods that conform to the contract. Your legal rights include rights where goods are faulty, damaged, not as described or otherwise do not conform to the contract.

Please contact info@aquilagin.com as soon as reasonably possible if an order arrives damaged, incorrect or appears faulty. Photographs and details of the packaging may help us investigate a courier or fulfilment issue, but a failure to contact us within an arbitrary short period does not remove rights you have under consumer law.

Opening a bottle does not remove statutory rights where a product is faulty or not as described. However, a change-of-mind return is different from a claim concerning faulty goods.

10. Returns Procedure

Before returning goods, please contact us so that we can provide the appropriate return instructions and return address. Do not return alcohol to a warehouse or other address unless we have instructed you to do so.

Where we are responsible for the return under applicable law, we will arrange or reimburse reasonable return costs as appropriate.

11. Promotions and Discount Codes

Promotions, discount codes and credits are subject to any specific terms stated with the offer. Unless stated otherwise, they have no cash value, cannot be transferred and may not be combined with another offer. We may withdraw or amend a promotion prospectively, but this will not affect an order already accepted.

12. Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site, even if we have been advised of the possibility of such damages.

Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action will at all times be limited to the amount paid, if any, by you to us during the six (6) month period prior to any cause of action arising.

Certain international laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers or limitations may not apply to you, and you may have additional rights.

13. Personal Information

We process personal information in accordance with our Privacy Policy. Please refer to the current Privacy Policy on our website for details of how we collect, use and protect personal information.

14. Changes to These Terms

We may update these Consumer Terms from time to time. The terms that apply to an order are those in force when the relevant contract is formed, unless a change is required by law and applies to existing contracts.

15. Governing Law and Disputes

These Consumer Terms are governed by the law of England and Wales. If you live elsewhere in the United Kingdom, you may also have the benefit of mandatory protections and rights to bring proceedings in the courts applicable to where you live. Nothing in these Consumer Terms removes rights that cannot lawfully be excluded.
